The mother of D. Gnanasekaran, the accused in the Anna University sexual assault case, has filed a habeas corpus petition (HCP) in the Madras High Court challenging his preventive detention under the Goondas Act after branding him as a “sexual offender”.
A Division Bench of Justices M.S. Ramesh and N. Senthilkumar on Thursday ordered notice, returnable by four weeks, on the Greater Chennai Commissioner of Police who had passed the detention order January 5, 2025 to protect public order.
To invoke the preventive detention law, the detaining authority had taken into account the sexual assault charge against the detainee as the ground case and three other criminal cases wherein he had been booked for charges such as theft and criminal intimidation.
